Congratulations to Travis Montgomery and Leslie Pollie on Their Recent Trial Victory

Indianapolis, IndianaTravis W. Montgomery and Leslie B. Pollie recently completed a two-day trial in Madison County, Indiana. This matter arose out of a motor vehicle accident wherein the plaintiff’s vehicle struck one of defendant’s horses, Ripley, who had escaped his enclosure and wandered into a nearby county road. The plaintiff claimed negligence and negligence per se and asked the jury to award $75,000 for alleged injuries due to the collision. The defense maintained that defendant’s fence, comprised of 8-foot treated wood posts anchored 3 feet in the ground and connected by steel gates and reinforced high tensile wire, provided an enclosure exceeding that which was reasonably required and that defendant had no reason to know or expect that his horse would escape. After only seven minutes of deliberation the jury returned a defense verdict. Congratulations to Travis Montgomery, Leslie Pollie, and their entire trial team!
