Lexington, Kentucky – Associate Dave Cecil and Managing Partner Brad Moore recently tried an automobile accident case wherein the plaintiff was a passenger in a van that struck our insured in an intersection. The plaintiff asserted the driver of his van had a green turn arrow and that our insured had to have run a red light for the accident to have occurred. The plaintiff’s primary claim for damages was an injury to his neck that ultimately resulted in a disc fusion surgery. At trial, the plaintiff asked the jury for $630,000 in damages ($70,000 in past medical expenses, $140,000 for future medical expenses, and $420,000 for pain and suffering). The primary liability defense our team presented to the jury was that there was no evidence that our insured had anything other than a green light as he entered the intersection. After deliberating for 25 minutes, the jury returned a unanimous defense verdict.
