James A. Milstone, Practice Co-Chair
Jim has handled numerous mediations and arbitrations, including bankruptcy, tort litigation, insurance coverage and mortgage foreclosures. He has served as a federal arbitrator for the Federal Emergency Management Agency (FEMA). Jim has been an advocate at more than 300 cases, including pre-filing and post-judgement mediations and has appeared in both state and federal court. Jim has an excellent reputation for litigation and has handled personal injury, products liability, trucking, construction, bankruptcy and creditor’s rights, environmental, tort, employment, civil rights, insurance coverage, first-party coverage disputes, alleged bad faith, and general commercial litigations.

Deborah A. Kapitan, Practice Co-Chair
Deb has been very active in the courtroom during her career. As a deputy prosecutor in Lake County, she tried over fifty-five felony jury trials. Deb spent six years on the bench as a Magistrate in Lake Superior Court Division III presiding over numerous jury and bench trials. Hearing many small claims trials as a Magistrate presented her with the opportunity to talk to lay people about legal issues and their impact on the litigant's case. Acting as a mediator, she can draw on her vast trial experience from the prosecutor's table to the bench to offer a unique perspective into cases. Deb has been a registered mediator and arbitrator since 2006. Her experience qualifies her to handle mediations in many areas including tort, contract, mortgage foreclosure, employment law and injury claims.

John L. Lisher
John has been in practice over thirty years and has had vast trial experience over that time
which has provided an excellent background for serving as a mediator and arbitrator. He has handled over 200 mediations and arbitrations in both state and federal court on cases
involving automobile and truck accidents, premises liability cases and product liability cases. He also served as a member of the court mediation week program when Marion County first started their mediation program.

Joseph M. Forte
Joe has served as a mediator in a number of civil litigation and workers’ compensation cases since 1992. Joe has been in practice for over 30 years litigating cases involving products liability, medical malpractice, construction, automobile accidents, accounting errors and omissions, legal malpractice, contract disputes, trucking, will contests, property law matters, liable actions, employment law matters, and general corporate and business matters. He is knowledgeable in all aspects of Medicare Set-Aside matters having made many successful submissions to the Center for Medicare and Medicaid Services. He brings experience, depth, wisdom and wit to the table as a mediator in a manner leading to a high success rate of case resolution through either mediation or as an advocate in litigation.

Douglas W. Meagher
Doug has been a registered mediator since 2002. He has extensive experience with Indiana worker’s compensation law having served as Executive Secretary to the Worker’s Compensation Board from 1989 to 1994, a Board member from 1994 to 1999, and practicing as a worker’s compensation defense attorney since 1999. As a Board Member, he was responsible for adjudication of worker’s compensation claims and draws upon this experience to effectively resolve disputes.
