RECENT CASE HIGHLIGHTS
John successfully obtained summary disposition for a client in a Michigan No-Fault case. The plaintiff filed suit seeking payment of first-party personal protection insurance (PIP) benefits. John was able to prove that the plaintiff materially misrepresented a preexisting spinal cord injury as well as claiming replacement services while traveling on vacation. John argued that the Fraud and Concealment Exclusion stated in the policy at issue was triggered by the insured’s fraud. Pursuant to the holding of Bahri v IDS Prop Cas Ins Co., the court agreed and dismissed the insured’s claim in its entirety.
