James H. Milstone, in 1985, received his Juris Doctor degree from the Valparaiso University School of Law. In 1982 he earned his Baccalaureate Degree with a major in English and a minor in Economics while attending Marquette University in Milwaukee, Wisconsin. While in law school, Mr. Milstone served as a Note Editor on the Valparaiso University Law Review.
After attending law school, Mr. Milstone served as law clerk for the Honorable Robert L. Miller, Jr. of the United States District Court for the Northern District of Indiana.
Practicing law in Indiana since 1989, his primary focus has been civil litigation. He has also handled significant products liability, trucking, construction, bankruptcy, environmental, employment, civil rights, insurance coverage, first-party coverage disputes, alleged bad faith, and general commercial litigations. Mr. Milstone also has handled numerous appeals in both the state and federal court systems, litigating in the Seventh Circuit Court of Appeals as well as the Indiana Court of Appeals and Supreme Court.
Mr. Milstone has been admitted to practice in the United States Bankruptcy Court for the Northern and Southern District of Indiana since 1985, and has considerable experience with bankruptcy and creditors’ rights litigation. He defends claims under the Fair Debt Collection Act and the Fair Credit Reporting Act, and has defended class action litigation.
Mr. Milstone is a certified mediator in the State of Indiana. He has also acted as an arbitrator.
Mr. Milstone has been admitted to practice law in the State of Indiana as well as in the United States District Courts for the Northern and Southern Districts of Indiana since 1985. He currently is a member of the Bar of the United States Court of Appeals for the Seventh Circuit, the American Bar Association, the American Bankruptcy Institute, and the Elkhart City Bar Association. He is also a member of the Defense Research Institute, the Trucking Industry Defense Association, and the Alternative Dispute Committee of the American Bar Association.
