Jacklyn Pasquale Paletta focuses her practice on a variety of insurance defense matters including directors and officers, errors and omissions, legal malpractice as well as retail and restaurant. Jacklyn specializes in defending Michigan No-Fault, PIP, and BI claims for multiple auto accident carriers. She has successfully tried cases to verdict in both district and circuit courts in Michigan. Jacklyn is also developing her practice in employment law, and is a dedicated member of the firm’s e¬mployment practice group. She has defended municipalities against claims of wrongful termination and discrimination, and has also defended school boards and board members against claims of defamation, libel, and slander.

 Jacklyn is extremely knowledgeable in the billing practices and methodologies of medical providers, and has become exceptionally familiar with the bill review processes of many of the companies that decide what and how to pay medical bills for insureds involved in auto accidents for the auto insurance companies. It is due to this knowledge that Jacklyn has been successful in motion practice, as well as at trial exploiting the arbitrary pricing scheme providers have implemented.

Jacklyn has effectively obtained awards for attorney fees in cases brought by providers involving fraudulent claims. She has also negotiated settlement agreements where the providers ultimately reimbursed the auto insurance carrier for overpayment of medical bills when she exposed that the bills were not supported by the medical records.

Prior to joining Kopka Pinkus Dolin, Jacklyn handled family and criminal law, in addition to other general liability claims. It was during this time that she handled cases involving child custody, personal protection orders, divorce, and post-divorce matters. She also worked with the NICB and county prosecutors’ offices on cases involving insurance fraud, including theft and arson. Throughout her time with the prosecutor’s office, she was involved in the prosecution of cases concerning assault and battery, as well as sexual abuse. She worked closely wit¬h law enforcement, victims and families of victims in prosecuting these sensitive and emotional claims.

One of Jacklyn’s trial victories appeared in Michigan Lawyers Weekly. The jury trial was a first-party case, involving a medical provider demanding payments from an auto no-fault carrier. The plaintiff claimed that, despite markups, bills for medical treatments rendered should be paid in full, because no-fault carriers do not have a contract that provides for a discounted rate. The defense focused on the arbitrary nature of the charges, and the claim that payments were made for the reasonable charges where proof of fact and amount of the loss were present. After two hours of deliberations, the jury ended the six-day trial with a no-cause-of-action verdict.
