The plaintiff was involved in a minor rear-end collision, and two years later underwent four surgeries within an eight month period; the Farm Bureau claim representative recommended an investigation. The defense retained experts who evaluated the plaintiff’s alleged injuries, and opined that the claimed injuries and subsequent surgeries would not be possible as a result of a minor rear-end collision. In addition, the defense also uncovered complaints/treatments dating back to 2010, at least four years before the accident, and continuing on a yearly basis up until the month before the accident.
The last demand by the plaintiff was $170,000, which was rejected by the defense with plans to proceed to trial. On the eve of trial, the plaintiff dismissed the case with prejudice and waived any and all claims against Farm Bureau for UIM benefits.
